Draft template — this document is provided for illustration and has not yet been reviewed by legal counsel. It will be replaced by the final version before any Kamiaja product launches.
These Terms of Service (“Terms”) govern your access to and use of kamiaja.com and the software products provided by Kamiaja (“Kamiaja”, “we”, “us”). By using our website or products, you agree to these Terms.
1. Acceptance of terms
If you use our services on behalf of a business, you confirm that you are authorised to accept these Terms on its behalf, and “you” refers to that business. If you do not agree to these Terms, do not use our services.
2. Our products
Kamiaja offers multiple independent software products. Each product may have additional terms, plans, or policies. If product-specific terms conflict with these Terms, the product-specific terms apply to that product.
3. Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for keeping your credentials secure and for all activity under your account.
- Notify us promptly of any unauthorised access or security incident.
4. Acceptable use
You agree not to:
- Use the services for any unlawful, fraudulent, or harmful purpose.
- Upload content that infringes the rights of others or contains malware.
- Attempt to gain unauthorised access to our systems or other users’ data.
- Interfere with or disrupt the integrity or performance of the services.
- Reverse engineer, copy, or resell the services except as permitted by law or by us in writing.
5. Your data
You retain ownership of the data you submit to our products. You grant Kamiaja a limited licence to host, process, and display that data solely to provide and improve the services. You are responsible for having the right to submit that data, including any personal data of your customers, and for complying with applicable law. Our Privacy Policy describes how we handle personal data.
6. Fees and payment
Some products or features may require payment. Prices, billing cycles, and payment terms will be presented before you purchase. Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes. We may change prices with advance notice.
7. Intellectual property
The services, including software, design, logos, and content, are owned by Kamiaja or its licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you. If you send us feedback, we may use it without obligation to you.
8. Third-party services
The services may integrate with or link to third-party services, such as payment providers or messaging apps. Your use of those services is governed by their own terms, and we are not responsible for them.
9. Availability and changes
We work to keep the services available and reliable but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features, and will give reasonable notice of material changes where possible.
10. Disclaimers
To the extent permitted by law, the services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the extent permitted by law, Kamiaja is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data. Our total liability for any claim relating to the services is limited to the amount you paid us for the relevant service in the twelve months before the claim.
12. Indemnification
You agree to indemnify and hold Kamiaja harmless from claims, damages, and expenses arising from your breach of these Terms or your misuse of the services.
13. Suspension and termination
You may stop using the services at any time. We may suspend or terminate access if you breach these Terms or if required by law. On termination, your right to use the services ends; where applicable, we will give you a reasonable opportunity to export your data.
14. Governing law
These Terms are governed by the laws of the Republic of Indonesia. Disputes will first be resolved amicably through good-faith negotiation; if that fails, they will be submitted to the competent courts in Indonesia.
15. Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the services after changes take effect means you accept the updated Terms.
